Terms of Service

Effective: October 2, 2026

DockHive is a developer cloud platform for deploying and running software: app hosting, the Drone AI deploy agent, HivePods cloud dev environments, managed databases, the hivepod CLI and related services (the "Services"). The Services are operated by DockHive Inc., a Delaware corporation, 131 Continental Dr, Suite 305, Newark, DE 19713, United States ("DockHive", "we", "us").

These Terms are an agreement between you and DockHive. By creating an account or using the Services you agree to them. If you don't agree, don't use the Services. Our Privacy Policy explains how we handle personal data.

1. Accounts

  1. You must be at least 18, or the age of majority where you live, to create an account.
  2. If you use DockHive for an organisation, you confirm you are allowed to accept these Terms on its behalf.
  3. Give us accurate sign-up details and keep them up to date.
  4. You are responsible for everything done through your account, including by teammates you invite and by API keys, CLI sessions or AI agents you connect to it. Keep your credentials safe and tell us straight away if you think someone else has access.

2. Acceptable Use

Don't use the Services to:

  1. Break the law, or infringe anyone else's rights, including intellectual property and privacy rights.
  2. Host, distribute or run malware, phishing pages, or anything designed to harm or gain unauthorised access to systems.
  3. Mine cryptocurrency, on any plan.
  4. Send spam or unsolicited bulk messages, or run open relays or proxies used for abuse.
  5. Attack, scan or overload DockHive, the node network, or other users' workloads, or try to get around plan limits or security controls.
  6. Host content that exploits children, promotes violence or terrorism, or harasses people.

We may remove content, stop workloads or suspend accounts that break these rules, where possible after telling you.

3. Your Content and Code

  1. You own your code. Your code, data and content stay yours. We claim no ownership of them.
  2. You give us a limited permission to store, copy, build, run and serve your content only as needed to provide the Services to you. That permission ends when you delete the content or your account, apart from backups that expire on their normal schedule.
  3. You confirm you have the rights to the code and content you deploy.
  4. DockHive keeps all rights in the platform itself: our software, documentation, brand and logos.
  5. Keep your own backups of anything important. Database backups depend on your plan.

4. AI Features

  1. When you use Drone, DockHive sends code from your repository to a third-party AI model provider so Drone can build your app, deploy it and fix problems along the way.
  2. Secrets and .env files are excluded and are never sent. If your app needs settings such as environment variables, Drone tells you; you supply the values.
  3. AI output can be wrong. Check that your deployed app works as you expect; you remain responsible for what you deploy.
  4. If you connect an AI agent (for example through the DockHive MCP server in the hivepod CLI), actions it takes through your account count as yours. Destructive actions such as deleting apps or HivePods require your explicit confirmation.
  5. See our Privacy Policy for how code sent to the AI model provider is handled. [AI provider data-retention terms — to be confirmed]

5. Plans and Billing

  1. Plans. Free Tier at no charge; Developer Plan at $3 per month; Pro Plan at $15 per month; Scale Plan on terms agreed in a separate contract. Current plan limits are on the pricing page.
  2. Usage overage. Use beyond your plan's limits is billed at the published rates, currently $2 per vCPU-month of compute (billed by the hour), $0.10 per GB-month of database storage, $0.02 per GB of bandwidth and $0.05 per build hour.
  3. Paid plans renew automatically each billing period until you cancel. Cancelling stops the next renewal.
  4. Prices exclude taxes, which are added where required. Fees are non-refundable except where the law says otherwise.
  5. If a payment fails we may limit or suspend paid features until it is settled.
  6. We will give at least 30 days' notice of price increases for your plan.

6. Service Availability

  1. The Free Tier, Developer Plan and Pro Plan come with no service level agreement (SLA). We work to keep the Services up, but they may be interrupted for maintenance, failures or reasons outside our control.
  2. Any SLA for the Scale Plan is set out in your contract.
  3. Workloads may run on independent nodes in DockHive's decentralized network. We may change, add or retire features, and will give reasonable notice before removing something you actively use on a paid plan.
  4. Apart from what these Terms say, the Services are provided "as is" and "as available", without warranties of any kind, to the extent the law allows.

7. Suspension and Termination

  1. You can stop using the Services and delete your account at any time.
  2. We may suspend or close your account if you seriously or repeatedly break these Terms, don't pay, or your use creates a security or legal risk. Where we reasonably can, we'll tell you first and give you a chance to fix it.
  3. After closure you'll have 30 days to export your data, unless we closed the account for abuse or the law stops us. After that, your apps, pods and databases may be deleted permanently.

8. Limitation of Liability

To the extent the law allows:

  1. DockHive is not liable for indirect or consequential losses, such as lost profits, revenue, data or goodwill.
  2. Our total liability for all claims about the Services is limited to the greater of the amount you paid us in the 12 months before the claim, or one hundred US dollars (US$100), whichever is greater.
  3. Nothing in these Terms limits liability that cannot be limited by law.

9. Changes to These Terms

We may update these Terms. For material changes we'll give notice by email or in the console at least 30 days before they take effect. If you keep using the Services after that, the new Terms apply; if you don't agree, you can close your account. Governing law and disputes: these Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in Delaware, and you and DockHive consent to their jurisdiction.
